Terms of Service — Coco Bedtime Stories

1. Acceptance of Terms

By downloading, installing, accessing, or using the Coco Bedtime Stories application ("Coco", "the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Service Description

Coco is a bedtime story application that provides:

• A library of classic bedtime stories with AI-generated narration and illustrations.
• Personalized story generation based on your child's name, age, mood, and daily events, powered by artificial intelligence.
• Audio playback with synchronized illustrations for an immersive bedtime experience.

3. Eligibility

The App is intended for use by adults (parents and guardians) aged 18 or older. Story content is designed for children to enjoy under parental supervision. By using the App, you represent that you are at least 18 years old and have the legal authority to agree to these Terms.

4. User Accounts

• An account is required to access personalized story features and manage your story library.
• You may create an account using Apple Sign In, Google Sign In, or email authentication.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• You must provide accurate information and promptly update it if it changes.
• You may not create multiple accounts or share your account with others.
• Notify us immediately if you believe your account has been compromised.

5. Subscriptions and In-App Purchases

5.1 Story Points

• Personalized stories are created using Story Points. Free accounts receive a limited number of Story Points.
• Additional Story Points can be purchased as in-app purchases through the Apple App Store or Google Play Store.
• Story Points are non-transferable between accounts and have no cash value.
• Unused Story Points do not expire as long as your account remains active.

5.2 Subscription Plans

• Coco offers optional subscription plans that provide recurring Story Points and premium features.
• Subscriptions are billed on a recurring basis (monthly or annually) at the rate displayed at the time of purchase.
• Payment is charged to your Apple ID or Google Play account at confirmation of purchase.
• Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the subscription rate.
• You can manage and cancel subscriptions in your device's app store account settings (Apple: Settings > Apple ID > Subscriptions; Google: Play Store > Subscriptions).
• Cancellation takes effect at the end of the current billing period. You will retain access to subscription benefits until the period ends.
• No refunds or credits are provided for partial subscription periods.

5.3 Free Trials

• Free trials, when offered, automatically convert to a paid subscription at the end of the trial period unless cancelled at least 24 hours before the trial expires.
• Any unused portion of a free trial is forfeited upon purchasing a subscription.

5.4 Price Changes

We may change subscription pricing at any time. Price changes for existing subscribers take effect at the start of the next billing cycle following notice of the change. Continued use after a price change constitutes acceptance of the new price.

5.5 Refunds

All purchases are processed by the Apple App Store or Google Play Store. Refund requests must be directed to the respective platform per their refund policies. We do not process refunds directly.

6. Content

6.1 AI-Generated Content

Personalized stories are generated by artificial intelligence based on inputs you provide. While we implement safety measures and content filters to ensure age-appropriate stories:

• AI-generated content may occasionally produce unexpected or imperfect results.
• We do not guarantee the accuracy, completeness, or suitability of AI-generated stories.
• Parents should review AI-generated stories and exercise their own judgment regarding suitability for their child.

6.2 User-Provided Inputs

You are solely responsible for the content of inputs you provide for story creation. You agree not to input content that is:

• Harmful, abusive, threatening, or harassing.
• Inappropriate for children.
• Infringing on the intellectual property rights of others.
• Intended to exploit, manipulate, or produce inappropriate content from the AI system.

6.3 Content Ownership and License

• Classic stories in the Coco library are original adaptations created by LayerNines Inc.
• AI-generated personalized stories are created for your personal, non-commercial use only.
• You may share generated stories within your household but may not redistribute, publish, sell, or commercially exploit them.
• LayerNines Inc. retains all rights to the underlying AI models, app design, and technology.

7. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of these Terms.
• Attempt to reverse-engineer, decompile, or disassemble the App or its components.
• Interfere with or disrupt the App's infrastructure, servers, or networks.
• Use automated scripts, bots, or tools to access or interact with the App.
• Attempt to circumvent subscription or purchase requirements.
• Create accounts using false or misleading information.
• Use the App to generate content for commercial purposes without written permission.

8. Intellectual Property

The Coco brand, logo, app design, illustrations, AI narration system, and all related intellectual property are owned by LayerNines Inc. and protected by applicable intellectual property laws. These Terms do not grant you any rights to use our trademarks, trade names, or branding.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LAYERNINES INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless LayerNines Inc. and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App, violation of these Terms, or infringement of any third-party rights.

12. Account Termination

• You may delete your account at any time through the App settings or by contacting support.
• Upon account deletion, all associated data (stories, profiles, preferences) will be permanently removed within 30 days.
• Active subscriptions must be cancelled separately through your device's app store settings. Deleting your Coco account does not automatically cancel app store subscriptions.
• We reserve the right to suspend or terminate accounts that violate these Terms, with or without prior notice.

13. Third-Party Services

The App may contain links to or integrate with third-party services (Apple App Store, Google Play Store, Firebase). Your use of these services is governed by their respective terms and privacy policies. We are not responsible for the practices of third-party services.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes through an in-app notification or by updating the "Last updated" date. Continued use of the App after such changes constitutes acceptance of the modified Terms.

15. Governing Law and Dispute Resolution

• Republic of Korea: For users in the Republic of Korea, these Terms are governed by the laws of the Republic of Korea. Disputes shall be subject to the exclusive jurisdiction of the Seoul Central District Court.
• Other Jurisdictions: For users outside the Republic of Korea, these Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and LayerNines Inc. regarding your use of the App.
